Terms of Service

These Terms govern your business’s use of the Perkfullloyalty platform (the “Service”). By creating an account you agree to these Terms and to our Privacy Notice. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

The Service

Perkfull provides software that lets you run digital loyalty programs — stamp, points, membership and multi-card — that your customers hold on their phones, and tools to manage customers, staff, outlets and messaging. Perkfull is the technology provider; you are responsible for the rewards, offers and their terms.

Eligibility & account

  • You must operate a legitimate business and provide accurate registration details.
  • You are responsible for your account, your staff’s access, and all activity under it.
  • Keep your credentials secure; notify us promptly of any unauthorised use.

Free trial

  • New accounts start on a 14-day free trial with no payment required.
  • When the trial ends your account is set to read-only — your data and your customers’ cards are retained — until you move to a paid plan.
  • Abandoned trial accounts that never enrolled a customer may be deleted after 30 days of inactivity.
  • We may change or withdraw trial terms for future signups.

Fees

Paid plans are charged at the rates for the plan and number of outlets you select. Fees are exclusive of any applicable taxes. Plan features and limits are described in the Service and may be updated on notice.

Your customers’ data

For the personal data of your customers, you are the controller and Perkfull is your processor, processing it on your instructions to provide the Service. You agree to:

  • have a lawful basis to collect and use your customers’ data and to provide them a privacy notice;
  • obtain the marketing consent required before sending offers, and honour opt-outs;
  • comply with UAE Federal Decree-Law No. 45 of 2021 (PDPL) and other applicable data-protection law.

Acceptable use

You agree not to misuse the Service, send unlawful or unsolicited messages, resell the Service without our agreement, or attempt to gain unauthorised access or interfere with its security. We may suspend accounts involved in fraud, abuse or non-payment.

Messages & push notifications

The Service lets you send messages, broadcasts, wallet-pass updates and push notifications to your customers. You are solely responsible for these communications — their content, timing, frequency, targeting and lawfulness — and Perkfull acts only as the technology that delivers them on your instruction. You agree to:

  • obtain and maintain the consent required to message each recipient, and honour opt-outs and unsubscribe requests promptly;
  • send only messages that are lawful, accurate, non-deceptive and relevant to the loyalty program the customer joined;
  • not send spam, or excessive, harassing, misleading or prohibited content;
  • comply with all applicable laws and with the policies of the channels used to deliver your messages, including the Apple Wallet, Google Wallet and mobile-carrier / SMS provider terms and acceptable-use policies.

Because these messages are delivered through Perkfull’s own provider and platform accounts, your misuse can put those accounts and every other merchant at risk. Accordingly, Perkfullmay, at its discretion and without liability, rate-limit, hold, disable or remove any message, and suspend or terminate your access to messaging or the Service, where we reasonably believe your use is abusive, unlawful, or in breach of these Terms or a delivery channel’s policy. You are responsible for, and will indemnify Perkfull against, any claims, penalties, losses or costs arising from the messages you send.

Availability & support

We work to keep the Service available but provide it “as is” without a guaranteed uptime unless separately agreed. We may modify or discontinue features on reasonable notice.

Suspension, termination & your data

You may stop using the Service at any time, and may delete your business account from your dashboard. Export any data you need first — deletion suspends your account immediately and permanently erases it 14 days later, as described in the Privacy Notice. If we terminate your access for breach, fraud or non-payment, you may request an export within a reasonable period, after which we may delete your data subject to legal retention requirements.

Disclaimer & liability

To the extent permitted by law, Perkfull is not liable for indirect or consequential loss, or for the rewards and offers you provide to your customers. Nothing limits liability that cannot be limited under applicable law.

Changes

We may update these Terms. Material changes will be reflected by a new effective date, and continued use after that date means you accept the updated Terms.
